Below you will find the information governing reservations, payments, and the general terms and conditions of seasonal rentals managed by Casapē.
1. Introduction
These Terms and Conditions govern the use of the Casapē Boutique de Imóveis (“Casapē”) website, as well as the making of reservations and the use of the accommodations offered.
By making a reservation, the guest declares that they have read, understood, and fully agreed to these Terms.
The rental agreement is characterized as a short-term lease intended for temporary residential, tourism, or leisure purposes.
2. Definitions
For the purposes of these Terms:
- Guest: the individual legally responsible for the reservation.
- Companions: individuals included in the reservation and authorized to occupy the property.
- Reservation: formal booking of the stay, including defined dates, rates, and conditions.
- Check-in: the time at which use of the property begins.
- Check-out: the deadline for vacating the property.
3. Reservation and Payment
3.1 A reservation shall only be deemed confirmed upon full payment of the daily rates and applicable fees.
3.2 The quoted amounts include the fees described at the time of booking.
3.3 Accepted payment methods may include:
- Pix (instant bank transfer – Brazil)
- Bank transfer
- Credit or debit card
- Other methods made available on the website
3.4 In the event of payment by credit or debit card, any payment gateway fees are non-refundable in case of cancellation, when applicable.
4. Cancellation and Refund Policy
4.1 The guest may cancel the reservation with a full refund if requested at least sixty (60) days prior to the check-in date.
4.2 In the case of payment by credit or debit card, administrative fees charged by the payment gateway will be deducted.
4.3 Cancellations requested less than 60 days prior to check-in are non-refundable, unless otherwise expressly agreed in writing.
4.4 Casapē may cancel a reservation at any time with a full refund of the amounts paid in cases of force majeure, including but not limited to:
- Severe weather conditions
- Natural disasters
- Structural issues or unforeseen emergency maintenance
- Security risks
- Legal or court orders
- Condominium or building restrictions
- Any situation that renders the stay unsafe or unfeasible
In such cases, the guest shall not be entitled to additional compensation, and refunds shall be limited to the amounts paid.
5. Check-in and Check-out
5.1 Standard check-in time is from 3:00 PM.
5.2 Standard check-out time is until 11:00 AM.
5.3 If the guest wishes to:
- Anticipate check-in to 11:00 AM; or
- Extend check-out until 3:00 PM,
A half-day rate will be charged, subject to availability and prior authorization.
5.4 Staying beyond the check-out time without authorization may result in additional proportional charges.
6. Property Use Rules
6.1 The maximum number of occupants informed in the reservation must be strictly observed.
6.2 The following are not permitted:
Parties or events without express authorization;
- Subleasing or assignment to third parties;
- Unauthorized commercial use;
- Disturbance of the building’s order, peace, or security.
6.3 The guest agrees to fully comply with all condominium rules and regulations.
6.4 Any condominium fines resulting from the conduct of the guest or companions shall be fully charged to the person responsible for the reservation.
7. Conduct, Safety, and Legality
7.1 Casapē adopts a zero-tolerance policy regarding:
- Discrimination of any kind (race, color, religion, gender, sexual orientation, nationality, disability, or any other form);
- Prostitution or sexual exploitation;
- Use or storage of illegal substances;
- Illegal possession of weapons;
- Illegal or immoral activities;
- Conduct that jeopardizes the safety of the property, condominium, or third parties.
7.2 Non-compliance may result in:
- Immediate termination of the stay without refund;
- Notification of the competent authorities;
- Legal and police action;
- Civil and criminal liability of the guest.
8. Liability and Personal Belongings
8.1 Casapē shall not be held liable, under any circumstances, for loss, theft, damage, or misplacement of personal belongings during the stay or after check-out.
8.2 It is the sole responsibility of the guest to:
- Keep doors and windows locked;
- Safeguard personal belongings;
- Properly use any security systems available at the property.
8.3 Casapē is not responsible for items left behind after departure.
9. Maintenance and Issues During the Stay
9.1 Any issues must be reported immediately to the Casapē team.
9.2 Problems not reported during the stay may not serve as grounds for subsequent compensation claims.
9.3 Emergency maintenance may occur during the stay if necessary for safety or proper functioning of the property.
10. Privacy and Data Protection
10.1 Personal data collected will be used exclusively for reservation management, compliance with legal obligations, and communication with the guest.
10.2 Data processing shall comply with applicable Brazilian legislation, including the Brazilian General Data Protection Law (LGPD).
11. Governing Law and Jurisdiction
These Terms shall be governed by the laws of the Federative Republic of Brazil.
The courts of the District of Rio de Janeiro – RJ, Brazil, shall have exclusive jurisdiction to resolve any disputes arising from these Terms.
12. Final Provisions
